Terms of Use for the Tango Argentino Wien Plattform

1. Scope and Subject Matter
These Terms of Use govern the use of the online platform Tango Argentino Wien (hereinafter "Platform"), accessible at tango-wien.at and respective city subdomains.

The Platform is a free community project for the Tango Argentino scene. It serves to make events (milongas, practicas, courses, workshops, festivals) visible and to connect the tango community.
By registering for or using the Platform, you accept these Terms of Use.
2. Description of Services
The Platform offers the following features depending on user role:
Public access (no registration required): View event calendar, event details, organizer profiles, DJ profiles and venues.
Registered users: Personalised features such as filter settings and calendar subscriptions.
Organizers (after approval): Manage own events, venues and organizer profile via an administration panel.
Tango DJs (after approval): Manage own DJ profile.
The operator reserves the right to modify, expand or restrict the functionality of the Platform at any time.
3. Free Service
Use of the Platform is free of charge. There is no paid contractual relationship between the operator and the users. The operator provides the Platform voluntarily and free of charge as a service for the tango community.
Due to the free nature of the service, there is no entitlement to continuous availability, specific features or permanent operation of the Platform.
4. Registration and User Account
4.1 Access
Access to the Platform as a registered user is exclusively by invitation from the operator or through activation of an organizer or DJ account.
4.2 Registration Obligations
The user agrees to:
Provide truthful and complete information during registration.
Keep login credentials confidential and not share them with third parties.
Inform the operator immediately if misuse of the account is suspected.
4.3 One Account per Person
Each natural person may create only one user account.
5. Netiquette and Code of Conduct
The Platform thrives on respectful interaction within the tango community. All users agree to:
Respectful conduct: Courteous and appreciative interaction with all community members.
No discrimination: No contributions that demean persons based on origin, gender, sexual orientation, religion, disability or age.
Factual accuracy: Event descriptions and profile information must be truthful and factual.
No spam: No unsolicited advertising, chain letters or off-topic content.
No illegal content: No content that violates Austrian law, particularly no copyright-infringing, defamatory or libellous content.
Fair competition: No deliberate harm to other organizers or the Platform.
6. Responsibility for Content
6.1 User Content
Users who publish content on the Platform (e.g. events, descriptions, profile images) are solely responsible for its legality. The user warrants that they hold the necessary rights to the published content.
6.2 No Monitoring Obligation
The operator is not obliged to proactively monitor user-submitted content. Upon becoming aware of legal violations, the operator will promptly remove unlawful content.
6.3 Usage Rights to Published Content
By publishing content, the user grants the operator a simple, free, and temporally unlimited right to make the content publicly accessible within the Platform. This right expires upon deletion of the content or user account.
7. Suspension and Termination
7.1 Termination by User
The user may terminate their account at any time without giving reasons by contacting the operator via email.
7.2 Suspension and Termination by Operator
The operator is entitled to temporarily suspend or permanently terminate user accounts if:
The user violates these Terms of Use, particularly the Netiquette.
The user provided false information during registration.
The user misuses the Platform or disrupts its operation.
Another factual reason exists.
Before a permanent suspension, the operator will generally inform the user and give them an opportunity to respond, where reasonable.
7.3 Discontinuation of the Platform
As this is a free community project, the operator may discontinue the Platform at any time without prior notice. There is no entitlement to continued operation. However, the operator will endeavour to inform registered users in advance of a planned discontinuation.
8. Liability
8.1 Operator Liability
The operator is liable for damages only in cases of intent and gross negligence. Liability for slight negligence is excluded to the extent permitted by law. This does not apply to personal injury; liability for personal injury remains unaffected.
8.2 Availability
The operator does not guarantee the continuous or uninterrupted availability of the Platform. Maintenance work, technical disruptions or force majeure may lead to temporary outages.
8.3 Third-Party Content
The operator assumes no liability for the accuracy, completeness or timeliness of user-submitted content (particularly event information).
8.4 External Links
The Platform may contain links to external websites. The respective operators are solely responsible for the content of external websites.
9. Data Protection
The processing of personal data is carried out in accordance with the Privacy Policy of the Platform, accessible via the "Privacy" menu item. The provisions of the GDPR and the Austrian Data Protection Act (DSG) apply.
10. Changes to the Terms of Use
The operator reserves the right to amend these Terms of Use at any time. Registered users will be informed of material changes by email. Continued use of the Platform after the changes take effect constitutes acceptance of the amended terms. If a user objects to the amended terms, they have the right to terminate their account.
11. Final Provisions
11.1 Applicable Law
Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
11.2 Jurisdiction
The place of jurisdiction is Vienna, Austria, to the extent permitted by law.
11.3 Severability Clause
Should individual provisions of these Terms of Use be invalid or unenforceable, the validity of the remaining provisions shall not be affected. In place of the invalid provision, the valid provision that most closely approximates the economic purpose of the invalid provision shall be deemed agreed.
